Protecting the privacy and confidentiality of personal information has always been a fundamental principle in our business relationships. We want you to know that Datalist adheres to privacy legislation that governs what information may be collected, how it is used and how it is protected. This Privacy Statement explains our privacy policies and information handling practices.

Datalist is committed to maintaining the accuracy, confidentiality and security of your personal information. As part of this commitment, Datalist has adopted the following ten principles, based on the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and the values set by the Canadian Standards Association's Model Code for the Protection of Personal Information which have also been incorporated into PIPEDA.

By providing your personal information to us, you are consenting to its collection, use and disclosure in accordance with the terms of this privacy policy. If you have any questions or concerns about our privacy policy or how we handle your personal information, we encourage you to contact our Privacy Officer , whose contact information is located at the end of this privacy policy.

  1. Accountability
    Datalist is responsible for maintaining and protecting the personal information under its control and shall designate one or more individuals to be accountable for compliance with these principles.
  2. Identifying Purposes
    The purposes for which personal information is collected shall be identified before or at the time the personal information is collected. To understand the purposes for which we collect personal information and how we use personal information, please see the paragraphs below entitled “ Why we collect personal information ” and “ What we do with personal information”
  3. Consent
    Individual's consent will be obtained for the collection, use or disclosure of personal information, except where the law provides an exemption.
  4. Limiting Collection
    The personal information we collect shall be limited only to that which is necessary for the purposes identified.
  5. Limiting Use, Disclosure and Retention
    Personal information shall only be used or disclosed for the purposes for which it was collected, unless an individual has otherwise consented or when it is required or permitted by law. Personal information shall be retained only as long as necessary for the fulfillment of those purposes.
  6. Accuracy
    We shall keep personal information as accurate, complete and up-to-date as may be necessary to fulfill the purposes for which it is to be used.
  7. Safeguards
    We shall protect personal information using security safeguards that are appropriate to the sensitivity level of the personal information received.
  8. Openness
    Datalist will provide information to individuals about our policies and procedures relating to the management of personal information that is under our control.
  9. Individual's Access
    On written request to our Privacy Officer , an individual will be informed of the existence, use and disclosure of their personal information that is under our control, and may be given access to that personal information as required and permitted by law. Individuals are entitled to challenge the accuracy and completeness of that personal information and request that it be amended, if appropriate.
  10. Handling Enquiries or Complaints
    Any questions or enquiries concerning compliance with our privacy policies and procedures may be addressed to our Privacy Officer .

Protecting your privacy means:

  • In accordance with the terms of this privacy policy, we keep the personal information you provide to us and all of the interactions between you and Datalist in strict confidence.
  • You have control over how we obtain, use, and give out personal information about you.
  • You have access to the personal information we have about you
  • We respect your privacy when we market our services to you. Datalist respects the privacy of every candidate and corporate client in regards to the use of confidential information and how it is presented and utilized in the normal course of business development and activity.

Why we collect personal information

We collect, use and disclose personal information only for purposes that a reasonable person would consider appropriate in the circumstances. Without limiting the foregoing, we initially collect information in order to determine whether there are any employment opportunities for you with our clients. If we determine there may be employment opportunities with our client, we will represent you on your behalf with the client for such employment opportunities. We also collect and use your personal information in order that we may provide information to you about our services.

The type of personal information we will collect from you includes, but is not limited to:

  • Resume type information. This includes, but is not limited to, education and work history, computer and other skills, languages spoken and references.
  • Your employment preferences, such as work location, salary, and other personal factors important to you

What we do with personal information

When you provide personal information to us in the form of a resume, references, complete a profile using our Technical Assessment Form, the information will be stored in our secure computer database that can be accessed by only those individuals who have a reasonable need to know such information. We may use your personal information to:

  • To determine whether you are a suitable candidate for any of our clients
  • Match your profile against our client's requirements
  • If we find that your profile matches one of our client's requirements, we will contact you regarding such profile matches and, with your approval, provide your profile and resume to such clients (see Your Information is Obtained or Used Only With Your Consent)
  • Contact and obtain information about you from references supplied by you and, upon your approval, send such reference information to our clients (see Your Information is Obtained or Used Only With Your Consent)
  • For other similar or related purposes that are reasonably necessary for the proper management of Datalist's business

Other disclosure of your personal information

Other than the foregoing, we may disclose your personal information in anticipation of and in the course of an actual or potential sale, reorganization, consolidation, merger or amalgamation of our business; and when required or permitted by law. The type of information we are legally required to disclose may relate to criminal investigations or government tax reporting requirements. In some instances such as a legal proceeding or court order, we may also be required to disclose certain information to authorities. Only the information specifically requested is disclosed and we take precautions to satisfy ourselves that the authorities that are making the request have legitimate grounds to do so. There are some situations where we are legally permitted to disclose personal information such as employing reasonable and legal methods to enforce our rights or to investigate suspicion of illegal activities.

Datalist consultants/placements

When you are placed with one of our clients, we will collect additional information in order to complete the placement process. In addition, we will survey you to ensure that we are offering our consultants the best possible opportunities and to provide our clients with constructive feedback. We will survey clients to verify and confirm the information we currently have in your file and to ensure our consultants are consistently meeting client expectations and to discuss with the consultants any comments (positive as well as negative) the clients may have.

We assume that once you provide to us your personal information you would like us to continue to look for employment opportunities for you. As such, once you provide us your information we retain it on file and try and obtain updated information until you tell us to remove your file from our records. All active contract consultants will receive communication from Datalist containing pertinent information related to current placements. If at any time you no longer want Datalist to pursue employment opportunities for you and no longer want Datalist to retain your file in our records, please let us know by contacting our Privacy Officer and we will remove your file from our records, subject to any record retention requirements under the law, immediately.

Your information is obtained and used only with your consent

Except as outlined in this privacy policy, or with your consent, we do not sell or provide candidate or client information to third parties. We will always obtain your authorization to contact references and we will always contact you via email or telephone before we submit your profile to a client requirement.

Your consent can be expressed or implied

Before we use your personal information, other than in accordance with the express provisions of this privacy policy, we will obtain your consent. Consent can either by ‘express' or ‘implied'. Express consent can be verbal or written. Implied consent is when it is reasonable to conclude that you have given consent by actions you have taken, or when you decide not to take action. For example, by providing your contact information, profile or other personal information to a recruitment specialist or through our website, you are granting your consent to allow Datalist to use your profile information in the matching process, and to contact you regarding any such matches.

You can withdraw your consent after you've given it

If you are uncomfortable with the terms of this privacy policy, you always have the option not to provide personal information to us, or withdraw your consent relating to certain of our information handling practices. In addition, you can request to have your information removed from our database, or opt out of receiving optional future mailings at any time by contacting our Privacy Officer . Please note however, that if you do not provide certain personal information which is required for us to provide the services that you have asked for, our ability to assess your qualifications and place you with suitable clients may be compromised.

We protect your information from error, loss, and unauthorized access

Our employees who have access to your information are made aware of how to keep it confidential. Each employee is governed by policies regarding information handling. Only employees who require access to your information in the course of their duties will have access to your information.

You can see and verify the accuracy of your information

You can update your personal information at any time by contacting Privacy Officer .

If you would like access to the personal information we have on file for you, we will ask you to put your request in writing. You will be given reasonable access to your personal information to verify or correct information. Every effort will be made to respond to your inquiry within 30 days. There may be circumstances provided for under law where Datalist will not provide you with access or may require additional time to meet your request, in which case you will be informed.

To help us keep your personal information up-to-date, we encourage you to amend inaccuracies and make corrections as often as necessary. Despite our efforts, errors sometimes do occur. Should you identify any incorrect or out-of-date information in your file(s), we will make the proper changes. Where appropriate, we will communicate these changes to other parties who may have unintentionally received incorrect information from us.

Updating this Privacy Policy:

Any changes to our privacy policy and information handling practices will be acknowledged in this policy in a timely manner. We may add, modify or remove portions of this policy when we feel it is appropriate to do so. You may determine when this policy was last updated by referring to the modification date found at the bottom of this privacy policy.

Links to other websites

Our website may contain links to other third party sites that are not governed by this privacy policy. Although we endeavor to only link to sites with high privacy standards, our privacy policy will no longer apply once you leave our website. Additionally, we are not responsible for the privacy practices employed by other third party web sites. Therefore, we suggest that you examine the privacy statements of those sites to learn how your information may be collected, used, shared and disclosed.
